Hayden suggested that Congress pass a bill preserving the area as a public park forever, warning of the dire consequences if they did not protect the area from private development.

John Colter, a former member of the Lewis and Clark expedition described a place in the northwest corner of the Wyoming Territory where mud boiled, water spouted, and steam came out of the ground; he was met with great ridicule.  There was no person from the United States in Yellowstone until he stumbled upon it in the winter of 1807.  He is not part of the specific history of the foundation of Yellowstone as a national park because he had no thought on the matter; but with John Colter, the possibility for its exploration became real.

In 1906, Theodore Roosevelt signed into law, The Antiquities Act, also known as “An Act for the Preservation of the American Antiquities."  This legislation gave the President the authority to restrict use of particular public land owned by the federal government, by setting aside certain valuable public natural areas as park and conservation land.  Prior to him becoming President, Roosevelt was  instrumental in Yellowstone, as he drafted many petitions and testified before numerous committees, encouraging key legislators to protect the park and its wildlife.  There are more National Park Service units dedicated to Roosevelt's life and memory than any other American.
